By the way, I got my FP notice for 23-Nov, a day after Thanks Giving. It looks like the original place for which I got the FP notice seem to open on that day. Is it true for all centers? What I mean to say is if a ASC is open in one region on a very likely holiday, the other ASCs would not be closed on the same day just because its a smaller center, will they?
Since all ASCs are federal offices, so dates of closure and holidays should be same through out, shouldn't it? Unlike the post offices, some are open on Saturdays and some are not....you see where I am going with this?

my mothe in law is visiting us. she came to the Us last Aug 2006 as a B2 (tourist visa). we extented her visa once which iwas valid for Aug 8, 2007. then we applied for the extention again. yesterday we received the letter saying USCIS is not going to extend the visa anymore. the application had been rejected. but they didn't mentioned any date in the letter about when she have to go back.
what is safe for her? does she have any deadline to go back? is it 15 days or a month....
someone please let me know...thanks ahead
Generally, they give only one extension. Technically, I think she is already overstaying? The bigger problem will be coming back next time. Did you try calling them?

It is very late to be submitting the RFE response now. CIS will probably deny the H-1B and your employer will need to refile. The employer should have asked for an extension before the due date.

I applied my 485 as a single on July 17th.
I got married and then applied my spouse's on Aug 16th.
Since I am married now, will that cause my application to get rejected as I applied as Single.
I am not sure how would this be handled at USCIS end ?
Any idea ?

Hi all,
I am trying to book my H1b visa interview in the U.S. Consulate at Delhi for end of December. However, I don't see any available interview dates at Delhi during that time from VFS website.
Am I doing something wrong? Can any of give me some guidelines?

Folks,
I got a RFE asking for a copy of birth certificate and bio info. I had sent my BC and bio info before while applying for 485 last august. I was hurrying up my lawyer to send the response as soon as possible.
My lawyer emailed me that since there is a spelling difference in the way my name is shown in my BC and in all other docs, I will be subject to additional security checks and there is no point in hurrying. Is this true or is my lawyer using this as a delay tactic ?
My name in my BC ends with .......iam and in all other docs ends with .....iyan. Should this cause a problem ?
Please share your thoughts and help me.

Well they are always saying they "want to start" discussions things can turn quick if they want to ... But the point is whether we "in" or are we "out" of discussions if we have atleast one point representation in those talks I think there would some help instead of asking all of us to go back and start process again, this is what 2007 CIR did and it would be if we do nothing... For me I have sent emails / calls when HR XYZA legislation of Lofgren was in discussions.. but those are small numbers and I wonder whether IV Core is doing something through their Lobbying channels... Surely its coming if not today during the tenure of President Obama.

Pl. keep your post updated for the benefit of others.
Also contact your attoneys and ask them to find ways to check if your petition is present in PIMS. My attorney says there is no way he can. I also called DOS & KCC, they are not helping either.

I got my GC approved for me and son (I485 application) in Nov 2007. I got my gc, whereas for my son who is 7 year old though he got I485 approved yet he did not get his GC. They mentioned they might need his finger print and so far no response from them. This is despite several follow up with them.
Last year 7 months he was not in US and now can he go to India and he will be there rest of this year.
Will it affect his GC and when will he get his GC?

Hi ,
My wife is in this situation where she would like to travel to Canada to see her sister.
We applied for 485 and have got out EAD( did not apply for AP, thinking of appying now.)
She has a H1B stamping from her old employer's H1, valid till 2009. She moved to a new company and the H1 there is pending.
Can she travel to Canada and comeback showing her old stamping ?
Are we abandoning the current H1 if we go out while its pending ?
She just wants to see her sister and they wont let them visit either. :(

Hi, I have strange situation, when I check status of my I-485, this is what I see:

According to their site I've already should have received either approval or denial of Applicatio to Adjust Status (I-485).
So my attorney called customer support # and claims that service representative told her that it refers to something mailed other than approval or denial having being mailed.
Well, since my attorney couldn't figure it out, I decided to call myself today. In my case, customer service rep told me that she isn't allowed to tell me whether it was approval or denial, but she said that it must be either one of the two. She offered to send me a copy of what was sent on Sep 2007 as per this screenshot above. So now I have to wait up to 45 days to see what it is.
I am wondering if anyone else has seen similar thing happen.
By the way, my priority dates aren't current. I am still in backlog, hence I am not so optimistic this could be approval or denial. I am actually more afraid whether or not my paperwork got stalled or something and it'll now never get resolved because of according to their system the matter has been resolved.
Anyway, if anyone has any advice or ideas that'd be appreciated,

My I140 (and I485) were filed in May 2010 (EB2, NSC). My attorney just notified me they received an RFE regarding my eduction. Apparently USCIS needs more details on my MSc degree from Poland (integrated, 5 years) and explanation why is it equivalent US masters degree.
Has anyone had a similar hurdle when filing under EB2 with a degree like that? Should I be terribly worried about getting my I140 approved or do cases like that normally go through (provided that an RFE is correctly replied to)?

My H1 is due for extension this year end.
Valid period of H1 remaining is 1 1/2 year since extension
I understand that H1 extension has to go through the rigorous procedure nowadays.
It needs client letter stating that project will last for 1 year.
Getting such letter is not possible.
So having I140 approved makes thing easy for H1 extension? Or same process for h1 extension is followed

Same process for a H-1 even if you get an I-140 approval, they may not require the client to say that the project will last for 1 year, i have seen that it is sufficient to say that the project is extendable. Ofcourse you might get an officer who is unreasonable, in which case you can file an appeal, no requirement in the law to ask for an 1 year contract to get a H-1.

I have been offered a grant assistantship to complete my PhD research early next year - spring 2008 (in the same field as job) and employer is OK with me going part time for a semester as it benefits them. Is it fine to do that or do I have to remain "full time" with employer while GC is pending?
2: If I use EAD for school (assistantship), will H1B be invalidated? My H1B has 4 more years. If AOS is denied by chance, what are my options?
3. What if the GC is approved in that 6 month while I am part time with company (as I am current now with EB2 ROW) do I have to switch to full time or "intentions" of being full time in future are sufficient?
4. Will the company (my current employer) have to provide a letter saying that I work 'full time' if there is an EVL while I am part time or they can give me an offer to work full time in the future?

My brother got a B1/B2 multi-entry visa for 2 years. My mother is a green card holder and my brother didn't want her to submit an I-130 on his behalf since she became a US resident. The reason was because one of the questions that the embassy asks when you apply to get a visa to enter the US is weather a relative submitted an I-130 on your behalf or not. If yes then the embassy thinks of you as you want to enter the US and remain there until ur I-130 is approved and a visa number is available.. my question is since my borther got his visa, will it be ok for my mother to submit an I-130 on his behalf now without having the embassy rejecting him B1/B2 visa in the future(that is after his current B1/B2 visa expire in 2 years ????
Another question if a person is in the US and out of status, can a relative submit an I-130 on his behalf and if yes how good is his chance to adjust his status when the I-130 is approved in the future??

Unless it is an expired "conditional status" card, your legal status in the US in no way changes. Only the card expires and not your legal LPR status! I don't quite understand what your "mistake on birthday" comment is all about!
You are still a legal permanent resident and can apply for a job proving your eligibility with your Social Security card and valid drivers license/state ID.
Get a new card by filling out form I-90 with USCIS and pay the required fees.
