Bring it on :p. I am on round 32 of Turbokick's. Six and half years of practice and I love it.
Just for Fun ... Take it easy. Great to have you on the team
I have been swimming and strength training for quite some time now and have started kettle bells and Taek Won Do this year. I do see a lot of women working out. All I am saying is that these forums have a lower proportion of females.......pure statistics.
And yes; there are a lot of females working out and the ones who do take up martial arts are more serious than the guys. However the most common excuse cited by the ones who hesitate to take up running/walking, is security. I am trying to get the ones who are not working out to get out; the ones who are; have a lot of tenacity.
.............BTW, be nice to me. By the time you come to DC to run the race, I might have my brown belt :)

I am a junior member and donate $50 to the IV every month. I am in the same boad with PERM after the audit. I do not understand why you guys are getting hostile with the guy that asked a question. It is a genuine question and needs discussion on the board whether you like it or not.

There are a lot of 2003 and 2004 filers still waiting. EB3 should be much more than EB2 because during this period, there was no visa retrogression and most people did not care about the category. Even some of those EB3's converted to EB2's, it did not really reduce the visa # demand or made the EB3 line shorter thanks to the infamous Labor Substitution. Needless to say the existing name check backlogs as well as the filing rush right before PERM. My guess is it will take at least a year for EB3 to move beyond 2004.

Fellow IV'ers,
We have done a good job since we started the 'Add ONE Member Campaign'.
In two days we were able to add 42 members. Welcome our most recent member, 'Gudavallign'!
But we can do a hell lot better.
The goal is for each of us to add ONE member by December 31st. Just ONE member. Cant we do that? I look around, and almost all my friends/family are stuck in this mess. All it takes is to talk to them and explain the great job IV is doing. I am sure you all know someone who is going through GC pain. I was easily able to join two members. All it took was 10 minutes each. I am confident of joining at least two more before the 31st.
Please dig your contacts, call/email them and explain this great effort. I request everyone who reads this post, to stop and call/email one friend (and make them a member) as an immediate priority, before even going on and reading the next post or thread on this forum.
If you are thinking it is a difficult thing to call, please use the 'Invite a Member' feature on this website. But please make the call/email NOW!
Everyone, please help add ONE member by December 31st.
Together we can make this campaign a success!
Thank you.
Lets make this campaign a success

This is very interesting data. Pending 485s = 593937!! and number received in Feb = 38,663. To simplyfy assuming 600,000 pending and 38,000 new per month. Which means they get 456,000 apps per year. The total quota of Family + EB + Lottery + Refugee + Special = 226,000 + 140,000 + 55,000 + 90,000 + 10,000 = 521,000.
So if all green card apps were on equal footing and were always allocated it would take more than 9 years to clear the pending applications. But we all know that that is not the case so it might be 10, 12 or 15 years before the backlog is cleared and that would the best case scenario. This means retrogression will only get worse.
Perhaps, you missed a zero. Broad calculations as per info given by you, suggests 1 year to clear, not 10 years. However, most of the unusual delay for retrogressed countries is due to per country limit coupled with the fact that most of the applications are from a handful countries. This results in non-retrogessed cases clearing less than a year, but retrogressed apps have to wait for several years. This is topped by non-availability of PD's of applications in system readable form (PD's are nowhere written but the paper applications), resulting in guess work (and back and forth cutoff date movements).

Sussie,
Your letter nor the proposed drft amendment to CSPA does not talk about the children of parents who applied their GC under employment based category and got stuck in the Labor Card approval stage for years and when labor got approved and I140 also got approved then again stuck due to Visa retrogression. We must include injustice being done to these children and should ask for retrospective amendment to CSPA to provide relief.

Hi,
Whatever you or I (or similar people) say is only going to get us red dots. Even if EB2 people talk sense, no one in EB3 is going to listen. It is simple human behaviour - we are all here to safeguard our own interests. Not still sure if the forum is going to side with EB3 or remain neutral. Surely they can support EB3 - they have the liberty to do so and it is perfectly right. In that case, EB2 should create their own platform to defend their interests... May be EB2 guys should think about it...In my opinion, everyone has the right in a democracy to work legally towards their goal / ambition . This is absolutely jutsified. It is not a sin. All that I am trying to say is that EB2 folks should be proactive and act before it is too late.
If EB3 were to race ahead of EB2 tomorrow, will they support EB2 or work for equitable distribution? How many amongst EB3 have used the Labor substitution to their advantage? Will they back out now? Let them touch their heart and answer this, instead of giving red dots :)
i fully support eb3 becoz their backlog and pain is more severe...... but fragmenting everyone in smaller groups..... like eb3 v/s eb2 v/s eb1 will not fix any problem...... i think there are anti-immigrants or people from other tracker websites who create fake ids to make people to fight with each other..... look at this eb2_unite guy..... she/he created his id today and is suggesting creating a new group of eb2...... i know for certain ..... 1000% certain that he will not do anything about creating a group...... he is writing inflammatory posts so that people here are divided and continue to talk rubbish......
this a$$ (eb2_unite) and other like him should be collectively shunned by everyone...... we are all educated and we should use our brain.... at least sometimes..... to see beyond the obvious when some a$$ writes inflammatory posts......

For that one of these two should happen. Eb3 should move forward and Eb2 should retrogress.
Or EB2 stays and EB3 alone moves forward.
Or EB3 stays and EB2 has to retrogress so much (to 2001)!
I guess chance for 1st and 2nd option are high. And, this would answer Ramba's question how EB3 for India would get approval for PD 2003. There are very few 2001 PDs left (per me). Relatively more 2002 and most of 2001 and 2002 are pending due to name check else they would have got their GC during July and USCIS would not have returned VISA numbers back to DOS nor some numbers would have finally got wasted (FY2007).
So next PD would be 2003 (and there are very few 2003 filings that were filed before June 2007).

Mass deportations will NEVER happen. Its too damn expensive and a lot of moral issues come into the equation.
I agree that border security should be the first step before any sort of legislative relief is discussed for Illegal Immigration. There were 3.5 million illegal aliens in 1986 when amnesty was passed. Today the number is 12 million+.
.
What's so immoral about sending them to their home country without splitting families? We are not putting them in prison/guantanamo. The first amnesty was a big mistake and not justifiable. C'mon 8 billion is a expensive? Illegals cost California 10.5 billion a year in welfare, stamps, education...
"That would reduce the incentive to illegally migrate here."
tough punishments and deportation would discourage every one
"I am more optimistic for something positive to happen with Republicans at the helm than the Democrats coz to take a positive step, you have to be clear on your position. With an unprecedented majority, the Dems could not accomplish anything with regards to Immigration. All they came up with phony legislations, just to keep the carrot dangling."
Agreed. I still fail to understand how a change in medical insurance can boost the economy or improve unemployment.
Interestingly this is the number one search result on Google for "Bill for Legal immigration"
Might well make the most of it!

I have applied for birth certificate at Indian Consulate, SFO and received from them. They simply attested the information on my Passport on their letter head..will that be sufficient or I should get it from MRO/etc from India?
Per my attorney- Date of birth info provided my anyone but the local municipality is insufficient and won't be entertained by the USCIS. Unless you and your attorney are willing to try your luk with the RFE, I'd suggest that you get the birth cert from the local authorities.

Having to wait 10 years for mere permanent resident status in a country in itself is ridiculous, compared to processing times in countries such as Canada, and Australia.
If anything, the period should be much shorter - about 3-5 years from entry as H1B (or any other work visa).
It's critical that the time start from date of entry with a work visa - not filing of labor certification/I-140/I-485. Many folks may have had to change jobs multiple times (for example, during and after the .COM bust) and the process would've restarted each time.

I have received messages from people who have been here around 10 years without a GC. I wonder how common this is. What do you think about proposing a "fast track" for people who have been here legally for more than a certain amount of time?

Slammer, if you got visa number last year you should have gotten an interview months back, UNLESS your consulate appoinment schedule is backlogged.
Good luck
Sorry, should have said that the NVC had visa numbers for us - last year. Of course we won't hear anything from them until our PD becomes current.
But thanks for the tip to simply call the NVC and inquire about the status of our application, until now we only called the automated system and sent inquiries by email. Talking personally to someone might give some more information than the automated response :"Numbers are not yet available."
I'll keep you posted ! And good luck to us all in the future ! :)

We need a new bill which supports legal
Instead of starting afresh with a new bill, it would be wise if our lobbying efforts for legal immigration adjust to the changing political winds in Washington.
How Would a Republican Congress Handle Immigration? The Washington Independent (http://washingtonindependent.com/101609/how-would-a-republican-congress-handle-immigration)
1. Based on the report above, the new heads of judiciary committee and Immigration Sub Committee are individuals who view "border security" as the first step towards Immigration Reform. Since a majority of members on this forum are LEGAL immigrants, we need not worry about any steps taken towards border security and ICE Enforcement.
2. We could take our efforts, straight to Congressmen Smith and King and explain the challenges we face in getting LPR status.
3. Congressman Smit represents 21st Congressional District (San Antonio- Austin) area, which has a sizeable Indian population. We can approach him after the elections and discuss our issues with him. I am not aware of Rep. Kings constituency in Iowa, but he can be approached as well.
4. Having a powerful "ear" to listen to our issues and given the limited controversy (Since a majority of US, are on the oft targeted H1B) associated with our immigration needs, we might ask the Congressman himself, what the right steps should be. (New Bill or take up the visa recapture bill (introduced by Rep. Zoe Lofgren).
5. Immigration Voice works with Patton Boggs to voice our concerns with the lawmakers. Former Senator/Congressman Trent Lott works with Patton Boggs. He was the house majority leader, Republican whip and is someone who has (or had) a lot of clout within the Republican party. He was a colleague of Rep. Lamar Smith. He might help us push for the legal immigration piece.[/B]

Absent legislation to address the visa availability bottleneck
for India EB-3s, for example, decades may pass between
the dates when petitioning employers tested the U.S. labor
market and when visa numbers become available. With an
ever-changing economy, the market test performed many
years earlier may bear little, if any, relationship to what the
U.S. labor pool looks like when USCIS finally confers green
card status on these individuals.
We can include above in our letter to lawmakers.
Also noticed on Page 53 of this report there are 506,410 unused EB visas and out of which 180,039 were recaptured. It means if somehow we convinced lawmakers to bring one more special legislation to recapture remaining EB visas approx 326K , then backlog would be removed. I guess IV is working on this
